These Terms & Conditions ("Terms") govern your access to and use of the Website and the services offered through it, including the sale, purchase, valuation, and inspection of used diesel generator (DG) gensets and related industrial machinery ("Services").

 By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website or our Services.

 About Ompere

 Ompere operates as a marketplace and facilitation platform connecting sellers and buyers of used DG gensets, assisting with price estimation, inspection coordination, buyer/seller matching, and transaction facilitation.

 Eligibility

 By using the Website, you confirm that:
 - You are at least 18 years of age
 - You have the legal authority to enter into transactions on behalf of yourself or the business you represent
 - All information you provide is accurate, current, and complete

Our role and the nature of our services

 Price estimates are indicative, not final. Estimates provided through our price calculator or by our team are based on the information you provide and prevailing market conditions. Final price is subject to physical inspection, verification of documentation, and mutual agreement between buyer and seller.
 We do not guarantee a sale or purchase. Listing your genset, or expressing interest as a buyer, does not guarantee a completed transaction.
 Inspections are conducted in good faith based on information available and the visible/testable condition of the genset at the time of inspection. Ompere does not guarantee that an inspection will identify every existing or latent defect.
 Valuations factor in equipment condition, age, KVA rating, brand, operational performance, and current market demand, but actual outcomes may vary based on inspection findings and supporting documentation.

 Seller responsibilities

 If you list a genset for sale, you agree to:
 - Provide accurate and complete information about the genset, including condition, age, KVA rating, brand, and maintenance history
 - Provide genuine ownership documentation and disclose any known defects or major repairs
 - Cooperate with the inspection and verification process
 - Provide accurate business and bank account details for payment processing, where applicable
 - Avoid misleading or false representations about the equipment

 Buyer responsibilities

 If you express interest in purchasing through Ompere, you agree to:
 - Provide accurate business and contact details
 - Conduct your own due diligence, including reviewing inspection reports and documentation provided
 - Complete payment only through agreed and verified channels
 - Comply with all applicable legal requirements relevant to the purchase

 Payments

 - Payments for completed transactions are processed through legitimate banking channels (such as NEFT/RTGS), in compliance with applicable tax and GST regulations.
 - Payments are processed only after successful verification and completion of agreed procedures.
 - Ompere may charge a service or facilitation fee for use of its platform. Any applicable fees will be clearly communicated before a transaction is finalized.
 - Ompere is not responsible for delays caused by incorrect or incomplete details provided by either party, or by delays at the banking institution's end, or by third-party verification processes beyond our direct control.

 Intellectual property

 All website content including text, graphics, logos, designs, and platform materials is the property of Ompere unless otherwise stated, and may not be copied, reproduced, or distributed without prior written permission.

 Limitation of liability

 To the fullest extent permitted by law:
 - Ompere shall not be liable for indirect, incidental, special, or consequential damages arising from use of the Website or Services, including but not limited to loss of profit, loss of opportunity, disputes between buyers and sellers, inaccurate user-provided information, or third-party actions.
 - Ompere does not guarantee the accuracy of price estimates, the eventual sale value of any genset, or the timeline for completing a transaction.
 Ompere's total liability arising from any transaction or use of the Services shall not exceed the facilitation fee (if any) paid by you for that specific transaction.

 Disputes between buyers and sellers

 While Ompere facilitates transactions in good faith, disputes arising directly between a buyer and seller regarding the condition, pricing, or terms of a specific transaction are primarily the responsibility of those parties. Ompere will make reasonable efforts to assist in resolving such disputes but is not obligated to act as an arbitrator or guarantor of the underlying transaction.

Termination

 We reserve the right to suspend or terminate your access to the Website or Services at our discretion, including in cases of suspected fraud, misrepresentation, or violation of these Terms. Where practical, we will provide notice of such action and the reason for it.

 Governing law and jurisdiction

 These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Indore,Madhya Pradesh, India.
